Guest Kim Posted September 20, 2019 at 06:46 PM Report Share Posted September 20, 2019 at 06:46 PM If the minutes of a meeting include what a person said in public comments (yes, I know that they shouldn't, and this practice is being changed) and the minutes are approved, can they later be changed if the speaker of the public comment disagrees with how the approved minutes recorded their comment? thanks
jstackpo Posted September 20, 2019 at 07:04 PM Report Share Posted September 20, 2019 at 07:04 PM If a majority agrees to the changes (or 2/3 if there was no notice of the motion to amend the previously adopted minutes), sure. Yours is a prime example why minutes contain (or should contain) only what was done, not what was said.
Guest Kim Posted September 20, 2019 at 07:25 PM Report Share Posted September 20, 2019 at 07:25 PM So at the next meeting, someone can make a motion to amend the previously adopted minutes to reflect the change and then, if the body votes to approve the change by majority, the secretary records that the minutes were changed? jstackpo Posted September 20, 2019 at 07:56 PM Report Share Posted September 20, 2019 at 07:56 PM Coupla points: 1): Majority vote is enough IF there was notice given ahead of time (see index page 696), otherwise 2/3 vote is required. 2): The original minutes are not changed, but the current meeting minutes describe the change. Why not just move to strike the "public comment" altogether? Fewer arguments, perhaps.
Guest Zev Posted September 20, 2019 at 08:02 PM Report Share Posted September 20, 2019 at 08:02 PM Yes, the secretary records that the change was made. However, the vote required is two-thirds if no previous notice was made, majority vote if previous notice was made, or a majority of the entire membership regardless of whether previous notice was made.
