HOW CAN A MOTION TO CHANGE THE BY-LAWS BE MADE TO PROPOSE A CHANGE TO BE VOTED ON AT THE ANNUAL MEETING?

The answer will be in the requirements set out in your own bylaws for the procedure to amend them.  Your bylaws almost certainly have a provision on amendments.  It's usually one of the last items in bylaws.  Those provisions must be followed.  They generally provide for some sort of previous notice of the change proposed and for a super-majority vote (such as a two thirds vote) of the  members.  If by some rare chance your bylaws contain no provisions regarding their amendment, then those are the minimum requirements in RONR.  See section 57 of RONR for the provisions on amendment of bylaws.  However, the provisions in your bylaws supersede those in RONR.

Thank you for your response. Our home owners Association President fired our Parliamentarian and replaced him with a member of the Board who is an obstructionist. How can we find a qualified local Parliamentarian to facilitate the spirit of Roberts Rules to enable dialogue and not use it to preclude Motions and member voting?

The National Association of Parliamentarians (NAP) and the American Institute of Parliamentarians (AIP) both have referral services. The NAP is the larger of the two and has a website you can use to search for professional registered parliamentarians and also to get information on your state association and state president and to find out if there are any local units in your immediate area.  Click on the “NAP in my area”  link.

As this is concerning a homeowners association also have a look at the website of the homeowners protection bureau www.hopb.co  

Hoa s are more regulated by (state) laws, covenants and bylaws than RONR and they all have precedence over RONR.
