Guest Jessep Posted January 26, 2023 at 11:39 PM Report Share Posted January 26, 2023 at 11:39 PM Good evening, A motion was made to nominate someone to fill a vacant seat. That nomination was voted 4 yes, 2 no and 1 abstain with 1 member not present. Our town governs that no vote can pass without 5 affirmative votes. Therefore, this vote failed. I'm wondering, what are the ways this nominee can be voted on again per RR's? My understanding was, only the 2 no votes can call for the motion to be reconsidered. Are there any ways within Robert's Rules that anyone other than the 2 no votes can call the question? Thank you!
Gary Novosielski Posted January 27, 2023 at 12:48 AM Report Share Posted January 27, 2023 at 12:48 AM The motion to Reconsider would not apply once that meeting ended, so it no longer matters who voted how. If a motion fails, it can simply be moved again (renewed) next time. So that's how you do it.
Rob Elsman Posted January 27, 2023 at 01:04 AM Report Share Posted January 27, 2023 at 01:04 AM I suspect the answer to the question will be found in the controlling state or local election law.
Alicia Percell, PRP Posted January 27, 2023 at 09:06 AM Report Share Posted January 27, 2023 at 09:06 AM Since the question is about how RONR works on this question, the term you'll want to review in RONR is "renewal of motions." In 12th ed. see 8:15 as well as section 38. General summary of what you'll find is that the same motion can't come back during the same session, but it can be made again at the next session even if it was voted on and failed at the prior one. So if you have regular sessions with new agendas each Monday night, and the motion fails this week, it can be made again next week. Or if the sufficient vote threshold is not going to be reached with this person, a motion could be made even at the same session to instead pick someone else who can achieve the required vote threshold. Rob Elsman Posted January 27, 2023 at 05:46 PM Report Share Posted January 27, 2023 at 05:46 PM I do not think that the renewal of a motion is relevant to an incomplete election.
J. J. Posted January 27, 2023 at 06:43 PM Report Share Posted January 27, 2023 at 06:43 PM Also, this sounds like an election. 46:32 would apply and the nomination could be made again.
