Sonya Verrillo Posted April 26, 2023 at 05:43 PM Report Share Posted April 26, 2023 at 05:43 PM Our PTA Unit bylaws state that the President cannot be a member of the nominating committee. Article VIII-Duties of Officers, Section # d. Be a member ex officio of all committees except of the nominating committee or the audit committee. The president may not be an ex officio, elected, or appointed member of these two committees. If the Unit also has a President-Elect, can that officer serve on the Nominating Committee (our bylaws do not separate out the duties of President-Elect in the bylaws.) Thank you for any insight. The rule in question provides that the President may not be a member of the Nominating Committee, but has no such provision for the President-Elect, which is a different position. Therefore, it would seem to me the President-Elect could serve on the Nominating Committee.

Yes, but the President-Elect is not made an ex-officio member of anything, and so would have to be explicitly appointed to that committee. Neither is the president, unless the bylaws say so.

Which they do, in this instance. For that matter there isn't any President-Elect unless the bylaws say so. Which they also do, in this instance.
