Guest Richard Posted June 18, 2010 at 02:31 PM Report Share Posted June 18, 2010 at 02:31 PM Can a bylaw be approved by the general membership of an organization that prohibits elections by acclamation? or would just requiring a ballot vote take care of this?If a bylaw was approved that stated that there needs to be at least two nominees for an office and there ends up not being two, what can be done? A motion to suspend the rules for the election of that office?

A motion to suspend the rules for the election of that office?Such a provision would be in the nature of a rule of order that could be suspended (RONR p. 17). So the rules could be suspended to permit only one nominee (and even if no motion was made but the sole nominee was elected that would not be sufficient to render the election invalid). Even if the rules could not be suspended that provision could be worked around so easily that it would be almost useless. All you would have to do is to nominate someone who has no chance of being elected or has agreed to be a "pawn" just to meet the bylaw requirement. Thomas Ralph Posted June 18, 2010 at 03:09 PM Report Share Posted June 18, 2010 at 03:09 PM Prohibition of elections by acclamation and requiring a ballot vote for elections are both valid bylaw options, and are not interchangeable. If there needs to be at least two nominees for an office, then you need to nominate two people. Nominate me, if you want.
Kim Goldsworthy Posted June 18, 2010 at 03:16 PM Report Share Posted June 18, 2010 at 03:16 PM If a bylaw was approved that stated that there needs to be at least two nominees for an office and there ends up not being two, what can be done? That is one pretty silly rule.If you ever have only one nominee, then move to re-open nominations, and nominate someone who would not serve if elected. Governor Arnold Schwarzennegger, or President Barack Obama, come to mind. So, go nominate the useless person, and, voila!, you have satisfied your silly rule.
