nominations for Board of Directors

Per our Bylaws, a director/officer of the Board shall serve a term of 2 years. John was elected at the last election, served 5 months and resigned. His position was filled by the next candidate with the highest number of votes. He would like to run for the Board again. Should he be allowed to run since he did not fulfill the term he was elected for? Most of the members believe he is inelligble until the 2011 election. Cannot locate any information regarding this topic in book. Any help you can give would be appreciated.

That's easy.

It violates no rule in Robert's Rules of Order for someone who resigned to be elected to that same office from which he resigned.

So go ahead and nominate, and elect, John.

Do your bylaws say anything about serving only one term in office and that's it? If he had served his full 2-year term, would he be ineligible to hold the office again?

Anyway, RONR does say that an officer who holds position for more than half the prescribed term is considered to have held it a full term. The inference being that John did not serve a full term in this instance. And if there's nothing else (bylaws, for example) preventing him from serving a second term, then as KG noted, RONR has no restriction against it. Whether the membership wants him back in is another question altogether.

Also, the typical process is when the Pres resigns, the VP ascends to that office and elections are held to fill that VP vacancy. Your bylaws may have something to say about that too. That's water over the dam perhaps now, but should John get elected again, and celebrate his five-month mark with another cul8r party, you might look into that.
