His term was up but because of an oversite we missed that he needed to run for that office again.How can we legally reinstate him now that the election is over? Our bylaws do say (we the board) can fill a vacated position untill the next election,then that person would have to run for the office they were appointed to. Would this cover our problem? Read them carefully, especially for the precise wording of the term of office. They may say that the treasurer continues to serve until a successor is elected, or they may say something else. If the general membership conducted the election, the general membership should complete the election. If the bylaws define the term of office to be 'until a successor is elected', at least you would still have a treasurer while you sort things out. As Mr. J suggested, read the bylaws carefully... just in case they do address this situation (which, to repeat the initial point, is not a vacancy in an office).
