New Dictator not President

Since January our Association went from 9 to 5 Board members. When it came time to vote at the annual meeting, those who could not attend signed their proxies and had one unit owner represent us all. Our main concern at that time (in which we all stated) was that we wanted to continue with a nine member board, but at the meeting the representing resident was told our say didn't matter and was totally disregarded. Now that we have had a Board of 5 people, they are changing rules left and right to their satisfaction. One thing being that they are now giving the Unit Owners an option about the care of the decks/balconies. It has always been the Assoiciations responsibility to repair any bad decks. They have given us 3 different choices but not including that they be responsible for any. Our building is 35 years old and now that things are starting to fall apart due to lack of maitenance over the years, they are throwing it at us to take care of. Can they do that? Also, people trying to sell there Units are now being told that in recent years rules werent followed as far as approval by the Board within 30 days. It's never been enforced because there have never been enough monies for the Board to purchase any of the Units. (Not enough funds available still) What most of it comes down to is the new President made mention to several people that she was hard nosed (putting it lightly, her words were much worse) and she didnt care who she made mad, she was going to run things her way. Do we have any rights to the changes she is trying to make? This used to be such a nice place to live.

They can do whatever the Bylaws give them the power to do. Proxy voting is illegal under RONR, so I hope your Bylaws are nice and lengthy to sort out all of these concerns you have.

I would also recommend you take a look at FAQ #20, elsewhere on this site. Since this appears to be an HOA, it may also be wise for the association to consult a lawyer, as such associations often have legal responsibilities.
