Guest Jonathan Posted July 11, 2010 at 01:36 AM Report Share Posted July 11, 2010 at 01:36 AM Our current bylaws call for no proxy voting. We are coming up on a very sensitive issue and people who are away on vacation would like to cast a vote via skype or video chat. Any suggestions, other then suspend the bylaws for this vote? Rob Elsman Posted July 11, 2010 at 01:48 AM Report Share Posted July 11, 2010 at 01:48 AM The general parliamentary law is that voting is limited to those who are actually present at a meeting. The rule is unsuspendable because it embodies a fundamental principle of parliamentary law. See RONR (10th ed.), p. 255, ll. 3-12; p. 408, l. 31, through p. 409, l. 2. Any suggestions, other then suspend the bylaws for this vote? You can't suspend the Bylaws for this purpose. The only option is to amend the Bylaws. If it's not possible to do that in time, the people who are away on vacation are out of luck.

Josh Martin Posted July 13, 2010 at 04:27 PM Report Share Posted July 13, 2010 at 04:27 PM While standing rules can be suspended, bylaws cannot. It's not quite that simple. Standing rules with application outside of a meeting context cannot be suspended. (RONR, 10th ed., pg. 257, lines 8-10) Rules in the Bylaws may be suspended if the rule specifically provides for its own suspension or if the rule is in the nature of a rule of order, although some rules of order may not be suspended. (RONR, 10th ed., pg. 254, lines 28-34; pg. 255, line 3 - pg. 256, line 2)
