President "appoints" vacancy postions

Is a president allowed to "appoint" officers to replace vacancies due to resignations? He is stacking the deck with cronies,postponing elections, and has made questionable decisions regarding the small treasury.

Background: We have a president of or garden association who is running things for his own agenda. He "ran" unopposed and was "placed" because no one else had time. His wife is the secretary under the same conditions. Two VPs, and the treasurer resigned because of his unorthodox methods of running things (delay in putting treasurer on bank account messy books, spending without membership agreement). He continues to fill the vacancies with his "appointees." Nominations to fill the vacated positions were announced to happen at a meeting and when the agenda showed no nominations or elections a member asked why not and was told by the president "it isn't going to happen tonight."

Our bylaws (as set forth by the city and county for community gardens)merely state "The garden association shall have a president, vice president, secretary, treasurer, and applications officer (that is applications for garden plots)" There are not even any rules about how they come to office, but as history has it, they are always elected from nominations for each office in December of every year to take office in January. The rules state that "Garden officers shall serve a term of office no longer than one year and shall not serve consecutive terms."

He has appointed a VP and made his wife treasurer. All spending signatures now fall under his roof. A large contingency wants him out. Can we oust him?

Only if the Bylaws grant him that authority (same applies to postponing elections and making decisions about the treasury). (RONR, 10th ed., pg. 440, lines 21-25)

Can we oust him?

If "we" is the general membership, absolutely. See FAQ #20, elsewhere on this site, and check your Bylaws to determine how to do so. Also note that any decisions the President made that he has no authority to make (such as appointing officers) are null and void. After you remove him, I'd raise a Point of Order about that to get these pretenders out as well.

After you get this mess settled, you might want to work on your Bylaws, as they appear to be lacking in a few areas.
