If a board of director was appointed by the existing board but the by laws state that the person appointed should have been voted on by the membership, Should all his votes be illegal and or not counted?

Correct.

If he never was a sitting member of the board as your bylaws describe the board (i.e., he was appointed fraudulently by a party who had no authority to do such an appointing), then, although his votes do not count, that does not imply that 100% of the business transacted is null and void.
