Guest R Corrigan Posted July 29, 2010 at 02:19 PM Report Share Posted July 29, 2010 at 02:19 PM Where I live, we had a Tenant's Association. One day we went in for our monthly membership meeting to find out that the board had disbanded the association and refunded everyone's dues. In order for them to refund the dues, it means that the board met, made the decision, closed the account at the bank and said the association was no longer. Can the board make that kind of decision? There have been some very unhappy people.
jstackpo Posted July 29, 2010 at 02:24 PM Report Share Posted July 29, 2010 at 02:24 PM Check the bylaws of the association. The board may well have to power to do what it did.(At least you got your money back!)
hmtcastle Posted July 29, 2010 at 02:26 PM Report Share Posted July 29, 2010 at 02:26 PM Can the board make that kind of decision? It seems unlikely but check the bylaws to see just what authority the board has (or had). If they had the authority to amend the bylaws then they had the authority to rescind the bylaws and that would have had the effect of dissolving the association (assuming it wasn't incorporated). If all else fails, you can always start a new association. And be careful about giving too much power to the new board!
Gary c Tesser Posted July 30, 2010 at 01:49 AM Report Share Posted July 30, 2010 at 01:49 AM If the board did not have the authority, then ... then ... Ooo, what a mess.
