Guest W. Heald Posted August 11, 2010 at 11:50 AM Report Share Posted August 11, 2010 at 11:50 AM I belong to a small club with its’ own set of By Laws. One section states, I quote “Any member who conducts himself in a manner unbefitting a member of this Club may be expelled by a decision of the Executive Committee (Board). The executive board shall determine the details of the suspension” They also have full control of the affairs of the Club. The Executive Committee suspended a member for what they determined to be misconduct. My question: What is the proper procedure to overturn the Exec. Comm decision and reinstate the member?Does this come under the rescind procedure?

Comm decision and reinstate the member?Does this come under the rescind procedure? You can't rescind a motion whose action has been completed. But you mention both expulsion and suspension. Expulsion is final. Suspension is temporary. So you can't rescind an expulsion but you might be able to rescind, or otherwise amend, a suspension. You also indicate that the executive committee has "full control of the affairs of the Club". If this control is exclusive then the general membership is powerless. So read your bylaws carefully.
