conflict of interest

I am in a fraternity and we are having a trial process with charges against an active. Normally our vice president is set up to be the persecutor and that is in our bylaws. I am afraid they will have the guy that made the charges be prosecutor but he was involved in the situation that these charges developed from.

Is there a rule where I can prevent this, other than ethics (ha)?

Well, if it really is in your bylaws, then clearly there is a rule in place.

If you want to make sure that rule is obeyed, you would need to point that out.

In a meeting context, that's done with a point of order. For example, if someone nominated this guy to manage the prosecution, you could raise a point of order that this would conflict with the bylaws, which provide that the Vice President is designated to perform that task.
