Guest Ken Posted September 15, 2010 at 05:20 AM Report Share Posted September 15, 2010 at 05:20 AM In our bylaws, if the chair fails to win relection as a member during his term, he ceases to be the chair. Our chair failed to win reelection as a member, but refuses to step down. What is the proper way to challenge the chair's credentials to preside? Josh Martin Posted September 15, 2010 at 06:53 AM Report Share Posted September 15, 2010 at 06:53 AM What is the proper way to challenge the chair's credentials to preside?Raise a Point of Order that he is no longer eligible to serve as chairman. When he rules the point not well taken, appeal from the ruling of the chair. A majority vote is sufficient to overturn the chair's ruling.
Larry Cisar Posted September 15, 2010 at 07:19 AM Report Share Posted September 15, 2010 at 07:19 AM And if he still refuses to follow the rules, put a motion from the floor to elect a new chair. But make sure you have most of the members supporting you.

Rob Elsman Posted September 15, 2010 at 07:06 PM Report Share Posted September 15, 2010 at 07:06 PM Raise a Point of Order that he is no longer eligible to serve as chairman. When he rules the point not well taken, appeal from the ruling of the chair. A majority vote is sufficient to overturn the chair's ruling. The chairman in question has no business ruling on such a point, since it involves himself in a way that is not in common with the other members. As soon as the point is raised, the chairman in question should relinquish the chair to a temporary occupant at least until the question has been disposed of. David A Foulkes Posted September 15, 2010 at 07:10 PM Report Share Posted September 15, 2010 at 07:10 PM My typical addition: if the Chair isn't going to play by the rules to begin with, he's unlikely to entertain a Point of Order (and likely Appeal) properly, nor would he be likely to relinquish the chair without resistance. But hey -- it's worth a try before venturing into Chapter XX I guess.
