Guest Chiefzig Posted October 14, 2010 at 02:22 PM Report Share Posted October 14, 2010 at 02:22 PM I belong to a fire department. Can the membership at any regular or special meeting suspend the bylaws or part of the bylaws to allow someone to run for office they are not qualified to run for? George Mervosh Posted October 14, 2010 at 02:28 PM Report Share Posted October 14, 2010 at 02:28 PM Why wouldnt they be able to suspend them?Because Robert's Rules state that you can't. RONR, p. 254If the bylaw language isn't convenient, it must be amended to better suit your society's needs.
Guest Roberts Rules of Order Posted October 14, 2010 at 02:35 PM Report Share Posted October 14, 2010 at 02:35 PM You cannot just suspend all or any part of a bylaw that has been adopted. You may have in place a bylaw that may provide certain reasons that they can be suspended. But you could never suspend them to elect somone into office that isnt qualified. Guest Frank Gardner Posted November 4, 2010 at 04:23 PM Report Share Posted November 4, 2010 at 04:23 PM Ok, my FD has a similar problem. Our nomiations start this week, The position of secratary is filled right now, but the person that fills it will no longer have the qualifacations for the position for the new election. We already know nobody is going to want the position. The current person is willing to continue doing the job but does not qualify. Is there anything in roberts rules as to if the president can waive the qualifications or leave the position empty until after the election and have president appoint a person to position? And if an election is called for, then you have to have an election (i.e. no appointment by the president). But if there's an eligible person for the present to appoint, why not elect him? And if he's not eligible, he couldn't be appointed anyway. And if no one wants job, who would be appointed?
