Nominating Committee

Hi

We have a constitution that states -

ELECTION: The election shall be conducted and chaired by the immediate Past President. Any paid-up member may be nominated by the Nominating Committee or from the floor at the Annual Meeting, with the prior consent of the nominee.

Terms of office shall be one year with the option of serving for another year upon the request of the Nominating Committee.

The incoming Executive may consider the preparation and adoption of a list of standing committees and the duties of officers and committee chairpersons.

Who is responsible for forming the Nominating Committee? We have a disagreement amonst the executive, some want the current president to form the committee and some want the past president. Are there any rules that govern this situation?

There might be rules in your bylaws. Look there.

If not, anyone can make a motion to form the committee and the assembly - not any individual - makes the decision to form it. The details of who is on the committee, &c., should be in the motion and those details are subject to amendment during consideration of the motion.
