An election was held to elect new officers and board members. According to the By Laws, the Ballots were to be sent out on or before December 1 and to be returned to an auditor by December 31st. The membership body was to be contacted with the results of the election via 1st class mail by January 31st with the officail election results. By some unforseen circumstances, the Ballots were sent out on December 5 and the ballots were to be returned to the auditor by January 5th. In accordance with the By Laws, a reporting was recieved from the auditor, at the request of the officers January 3rd. The results were then posted on a public forum(as unofficial). It was brought to the attention that the ballot stated January 5th as the official closing of the election. The auditor was contacted and told to keep counting until January 5th, and give an official count. No ballots were discarded, and the votes are still being counted.

Is the election still valid since the official count needed to be notified by 1st class mail?

The answer to this question involves interpreting customized rules in your Bylaws, and is therefore beyond the scope of RONR and this forum. It is up to your organization to interpret its own Bylaws. See RONR, 10th ed., pgs. 570-573 for some Principles of Interpretation.
