AFTER THE ELECTION OF PRESIDENT OF A HOME OWNERS ASSOCIATION THE PERSON ELECTED ANNOUNCED THAT HE CAN NOT SERVE. DOES THE CANIDATE RECEIVING THE SECOND MOST VOTES NOW BECOME PRESIDENT?

No, the person receiving the second-most votes could not possibly have received a majority of the votes cast. In order to be elected, a candidate must get not just more votes than any other candidate--he must get more votes than all the other candidates put together, i.e., a majority--more than half.

If the person declined the office as soon as he learned of his election, then the election is incomplete. You will have to hold additional balloting for that position until someone gets a majority. If he accepted the office, became president, and then resigned, the Vice President becomes president as soon as you accept the president's resignation.

If the election was completed, but for some reason your officers do not assume their new offices immediately upon being elected, check your bylaws to see what they say about this situation.
