We have a situation in our association during a disciplinary review that involved legal action and the situation went to court. The members of the handling grievance committee ordered a copy of the court transcripts. The situation involved two of our members but nothing to do with their roles as members of our association. Does this Committee have a right to use this or even order this information which has nothing to do with their duties within our membership??

RONR does not limit what evidence or materials that can be used in conducting business nor how it is obtained.

Nothing in RONR would prohibit it. A society is not limited to disciplining its members for actions related to their membership. See RONR, 10th ed., pg. 630, lines 1-7.

Well, if they didn't obtain a copy, how would they be able to decide whether or not it was relevant? It seems to me they would have to read it to find out. How do you know it's not? Did you read it? Did you have "a right" to?

It is not uncommon to impose discipline on members, not for things they did within the society, but for things they did outside, which brought discredit upon the society. You should carefully read Chapter XX of RONR as well as any custom procedures regarding discipline which may be contained in your bylaws before assuming that any particular evidence is not useful.
