Guest susan smith Posted January 18, 2011 at 01:44 PM Report Share Posted January 18, 2011 at 01:44 PM Our By-Law are clear on replacing Commodore with the Vice Commodore (in the case of the Commodore being unable to serve or disciplined out), but not clear on replacing the Vice Commodore with the Rear Commodore. Our organization operates via automatic ascension; Rear Commodore becomes Vice Commodore, Vice Commodore becomes Commodore. Would the Rear Commodore automatically become Vice Commodore if the Vice Commodore is unable to serve or is disciplined out?
jstackpo Posted January 18, 2011 at 02:10 PM Report Share Posted January 18, 2011 at 02:10 PM I presume your organization calls on tradition or custom (RONR, p. 17) for your assertion that it "operates via automatic ascension" since you do not have any explicit rule to that effect. No problem in your doing so; indeed RONR suggests, in a slightly different context, p. 442, that your's is the appropriate system. You might do well to amend your bylaws turning your custom into a rule so there will be no question later on. hmtcastle Posted January 18, 2011 at 02:37 PM Report Share Posted January 18, 2011 at 02:37 PM Additionally, procedure is in place for the Commodore tp be replaced by the Rear Commodore if the Vice Commodore is not available. It's one thing to fill in for an absent officer and quite another to actually assume the office. I'm not as confident as Mr. Stackpole that, in the event of a mid-term vacancy, the succession from rear to vice is as automatic as the vice-presidential successions described in RONR. It all depends on your bylaws (a document none of us has read).
jstackpo Posted January 18, 2011 at 03:26 PM Report Share Posted January 18, 2011 at 03:26 PM My "confidence" related to the appropriateness of tradition or custom in dictating what was proper in the situation described, not whether "automatic ascension" in the case of a V-P vacancy not caused be a presidential vacancy is clearly sanctioned by RONR.AIP opinion 2009-532 dealt with the question and the opinions committee members, at the time, were unable to come to an agreement.
