How can we get rid of Treasurer?

We held a special meeting to state petition fo recall of our Treasurer. He isn't following what the bylaws discribe as his duties of office. Not making bank deposits, and refusing to give monies to our President or anyone else to proceed with normal business...as supplie buying, funding events etc. At this meeting a Question of Privilege was asked. "Why can't he just be expelled off the board?" IF we do a recall everyone will be fighting each other & taking sides...friends against friends; till we have a war. Since our bylaws only cover recall & resignation; but state that Roberts Rules of Order will be used (if anything isn't clarified by our bylaws) isn't there a way to unseat this officer? He has now gotten a group together to recall our President who has only held 1 meeting. Does this not scream of retaliation? This same officer has said he will ruin the council from the inside out....and I believe it! This is a resident council for senior high rise....you would think we'd all behave better!!! HELP!!!!

See FAQ #20 at the Robert's Rules of Order website, www.robertsrules.com.

You need to read and follow the discipline rules in your bylaws, consult Chapter XX of RONR, and read FAQ #20.

The more you know the rules and use them, the more calm and effective you can be.

If your Bylaws have a customized procedure for removal, you must follow that procedure, no matter how messy it might be. Pay close attention to the last sentence of FAQ #20.

Does this not scream of retaliation?

That is certainly one possibility. It is also possible that there are legitimate concerns with the President's performance. You would have a better idea than I would.
