Election of Incumbent Termed Out

My organization is preparing to hold elections for officers.  We have an incumbent President who has served 5 terms, the maximum allowed in our bylaws. An amendment to the bylaws allowing for a 6th term failed by one vote in our Representative Assembly.  There is an attempt to put the bylaw amendment out to a vote of the membership of our organization and place the incumbent on the ballot provisionally simultaneously.  Would this be legal?
