As some have already read in my previous posts. Our members are at odds with the the President. Not unusual I guess.

Our Bylaws state that the President "presides" at the annual meeting of members. Well and good. But since he has already unfairly tried to interfer with the election of new Board members (function reserved to the membership).. We would like to know if he is allowed to open the meeting with a speech which would again, try to influence the following election of Directors. He has been aggressively trying to undermine any opposition to his "rules" Can he abandon his impartiality by making a speech? Aimed at dividing the membership?

No. This is out of order because it would compromise the President's position of impartiality and because it is out of order to make a speech when no motion is pending.

Can he abandon his impartiality by making a speech? Aimed at dividing the membership?

Well, he could relinquish the chair to speak in debate while the election of directors is actually pending. He could not return to the chair until the election is completed. If he wishes to speak when no motion is pending, he would need the permission of the assembly (majority vote).
