Our bylaws state that the ex-president becomes a member of the board in an ex-officio capacity if not elected to another position on the board. Our bylaws state that the nominating committee can only have ONE member of the board on the committee. The president ex-officio has been selected in addition to the Corresponding Secretary. The question - does the president ex-officio count as another board member on the nominating committee?

It is ultimately up to your organization to interpret its own Bylaws (see RONR, 11th ed., pgs. 588-591), but it may be helpful to know that so far as RONR is concerned, there is no distinction between an ex-officio member and other members of the board. See FAQ #2 for more information.

On a side note, I would avoid using the term "president ex-officio" as it suggests that the individual is the current President by virtue of some office he holds. In actuality, the individual is what is commonly referred to as the "Immediate Past President" and he is an ex-officio member of the board (an arrangement many members of this forum advise against). In case there is any confusion, note that "ex-officio" means "by virtue of the office" - it does not necessarily refer to an ex-officer.

If he's a member of the board (and he is, regardless of how he got there), then he's a member of the board and would count as such. Though be advised that RONR says that the president should have nothing to do with the nominating committee.

Oops, I didn't read the original question carefully enough and see that we're talking about a past president, not the current president.
