The law states public comment must occur prior to action being taken by the Board. Just looking for a best practice approach. Perhaps it is: the chair reads the agendized item. Seeks board comments and then public comments. Once done, ask for a motion. But should a motion and second come before any discussion? If all that is said on this matter is that "public comment must occur prior to action being taken by the Board," then it seems to me the board is free to take public comment in any manner it sees fit so long as it occurs prior to action being taken. RONR does not provide any best practices in this regard. Since this appears to involve applicable law, it may also be advisable to seek legal advice on this matter. Definitely before any of the members discuss the topic. Whether public comment occurs before or after the motion is made is up to you.
