When the Nominating Committe nominates someone to run for Office and they refuse, can they run by petition?

Do you mean, the individual was asked to put his name up for nomination, the individual refused to have his name put up for nomination, and now wants his name up for nomination?

Yes, the individual can run for office after saying "no" to the nominating committee.

"... by petition ..."?

Forge this "petition" business.

It isn't required under Robert's Rules of Order.

If your own rules require peitioning, then that is purely up to you and your collective administration of your unique rule.

If a full slate of officers cannot be found prior to the date the Nominating Committee is to present the slate, can the Nominations be held OPEN?? IS A MOTION NEEDED TO DO SO? BETTY K

Once the nominating committee presents its report (however complete or incomplete), nominations from the floor are then taken. No motion required as it's just part of the normal electoral process.

It's even better than that. :)

If you were to follow RONR to the letter, then NO MOTION WOULD BE NECESSARY - because the chair is supposed to, automatically, call for nominations from the floor, immediately after the report from the nominations committee.

So, your chair is leaving out (or, risks leaving out) the above automatic step.

It is no sin for a Nom. Comm. to fail to fill every open slot. - It happens.

The members still have a shot at nominating good people spontaneously, at the meeting where the report of the Nom. Comm. is given.
