Guest Dick Hardel Posted March 19, 2012 at 10:59 PM Report Share Posted March 19, 2012 at 10:59 PM Situation: At a Homeowner's Association meeting the Covenants (& Constituion & Bylaws) state that any sale of common area property must be done by ballot sent to all members in good standing at least two months before the Annual Meeting. They were also given the date by which their ballot must be received. For the resolution to be adopted (to sell a certain property) it must be approved of at least 2/3rds of the members in good standing who voted on this resolution. All this was done and the votes were records. But before the vote was announced at the 2011 Annual Meeting, members at the meeting listed some questions they felt needed to be answered before the vote could be announced. A move to table the motion to announce the vote was adopted and the vote was tabled until the 2012 Annual Meeting.Question: Does the Board have to send all new ballots to the members in good standing to vote again on the resolution in preparation for when the motion is taken off the table at the 2012 Annual meeting, or upon providing the anwers to the questions asked at the 2011 Annual Meeting, does the President of the Association simply announce the results of the vote that had been taken in 2011? You cannot table or postpone anything to a meeting beyond the quaterly time interval (p. 214, 19-28).The fact that the announcement was not made does not detract from the fact that a vote was taken; it may be announced at the next regular meeting.
