Guest alo2497 Posted April 6, 2012 at 02:17 PM Report Share Posted April 6, 2012 at 02:17 PM I have a member that has been expelled from a company within my department. This Auxiliary company is a part of the department. This member now has submitted and application to join the department. Our By Laws do not specifically do not mention this not being permitted. Is there any way we can keep this member from joining our department?
Trina Posted April 6, 2012 at 02:33 PM Report Share Posted April 6, 2012 at 02:33 PM The answer would have to be found in your own rules (bylaws), or perhaps in whatever documents describe the relationship between the company and the department. Look there for membership elgibility rules and/or for rules on how submitted applications should be handled. RONR won't help you answer these questions -- it simply says that the bylaws article on membership usually covers (among other things) 'qualification or eligibility for membership, with application and acceptance procedures, including the method of reviewing and voting on applications.' (RONR 11th ed. p. 571 ll. 25-27)
Rev Ed Posted April 6, 2012 at 05:37 PM Report Share Posted April 6, 2012 at 05:37 PM Also, is this person applying for a job? If so, and assuming that the person is qualified to perform the position, you might want to talk with an employment lawyer.
