Chairman conflict of interest

Our organization is holding a special called meeting to discuss ethic conduct by certain members. However, one of the members in question is the chairman.

our by-laws state he interprets the rules and by-laws.

Can our group elect a moderator to conducted this special called meeting since the chairman is one of the parties involved and clearly a conflict of interest in his part?

what rule allows the election of a temporary chair or moderator for this special called meeting/

Until the point where there are specific charges again the chairman, or he is named individually in an investigation, he can preside. You would have to sespend the rukes (2/3 vote) to temporarily remove him from the chair,

yes the chairman and two other members have specifically being name in the charges for the ethic committee to review. However, in addition to being chairman of the organization, he is also the chair of the ethic committee

The same principle applies. If the chair is named with other members, he may preside. If there are actual charges, however, the assembly may adopt a motion suspending these members until the trial.
