Our By-Laws state that the Board consists of the Pres, VP, Secretary, Treasurer, last available Club Pres, & two elected members. The last available president is the only position of these that is not elected; it is appointed based on past president status.

Our By-Laws also require elected officials to have paid their dues in order to be elected to a position. Because the past president is not an elected position would this mean that if they don't pay their dues they can remain on the Board?

You'll have to interpret your own bylaws (no one here has, or will, read them).

Although if I understand what you've written, the "last available club president" is automatically (i.e. ex officio) a member of the board. So no appointment is necessary.
