So first, only members of the body which is meeting have any rights under RONR (even if he is an Association member he would be considered a nonmember if he wasn't a Board member as well). Second, even if he was a Board member he would have to seek permission to record the meeting. As for if it is "legal" you would need to ask a lawyer.
