If a member is suspended and while he is on suspension his organization consolidates with another organization to form an entire newly orgainzation is this suspened members a member of the new organization? this is not covered under any of the orgainzations by-laws.

RONR doesn't have any specific words about this situation either (i.e. what happens to a 'suspended' member when his organization morphs into a new/different organization).

Suspension usually means that specifically enumerated rights of membership are no longer available to the member during the period of suspension.

I doubt that, 'the right to remain a suspended member of the organization if, by chance, our organization merges with another organization and becomes a new organization in the process' was on that enumerated list of suspended rights.

Another way to look at it is to consider how ANY members of the old organization became members of the new organization. Since the old organization presumably ceased to exist when the new one was formed, how did membership rights continue for any of the old members? Whatever the procedure was, is there any reason to assume it didn't apply equally to the suspended member?

". . . a new set of bylaws must be drawn up and adopted." - RONR (11th ed.), p. 563, ll. 17-19. See pages 561-563 for other pertinent information.
