Guest Waymer Posted August 25, 2012 at 05:37 PM Report Share Posted August 25, 2012 at 05:37 PM Is it LEGAL to hold the first meeting of the year (September) in August? One rule states that newly elected members can't take office until September 1st, so if the September meeting is moved to AUGUST, then do the OLD members NOT re-elected attend the meeting AND vote for the chairman, vice-chairman? This seems to be a double edge sword, as it appears to be an attempt to have the officiers elected by members that will NOT be on the board for the new year... Guest stat Posted August 25, 2012 at 08:47 PM Report Share Posted August 25, 2012 at 08:47 PM People cruising on this board usually won't answer questions that require a legal opinion. Under your rules who is allowed to call (or move) a September meeting? When do your rules require the voting for Chairman, Vice Chairman, etc to take place?(September? or is there no rule?)Who do your rules require cast these votes? Newbies or Incumbants or not specified? Even if the old crew votes, do the rules give yournewbies the right to vote for these positions at their first meeting? sMargaret Posted August 25, 2012 at 10:27 PM Report Share Posted August 25, 2012 at 10:27 PM Also, what are you trying to do in this meeting? Is it a general meeting or a board meeting? Are you electing the board from the general members? Just because the board can't take office until September doesn't mean that the general members can't elect a new board in August, to take office in September. Guest Edgar Posted August 26, 2012 at 03:06 AM Report Share Posted August 26, 2012 at 03:06 AM Is it LEGAL to hold the first meeting of the year (September) in August? If you're referring to your organization's annual meeting and if its date is established in your bylaws, then it can't be changed without changing (i.e. amending) your bylaws.
