Guest Robert Posted November 8, 2012 at 03:08 AM Report Share Posted November 8, 2012 at 03:08 AM When a vote is held on a moton to amend a by law (process satisfied), should the vote be secret ballot or show of hands. Current by laws does not specify. Only specification is that the motion needs 2/3 to pass. Thanks.
jstackpo Posted November 8, 2012 at 03:24 AM Report Share Posted November 8, 2012 at 03:24 AM The usual requirement for a 2/3 vote is a "standing vote". Much more reliable than voice.Anybody can move that the vote be by secret ballot, however. This is a decision for the assembly to make - majority vote. Guest Patrick Eisenhart Posted November 13, 2012 at 06:40 PM Report Share Posted November 13, 2012 at 06:40 PM What happens if a by-laws change passes a majority vote and later it is discovered that a 2/3 majority was required and not present, is the vote of the majority null and void? jstackpo Posted November 13, 2012 at 07:19 PM Report Share Posted November 13, 2012 at 07:19 PM No. The amendment stands. The time to "discover" the error is when the vote is announced -- it is a point of order to draw attention to the error and points of order have to be timely (with exceptions - this isn't one of them). p. 251. 250.
