Guest Dan Fargo Posted February 12, 2013 at 02:38 AM Report Share Posted February 12, 2013 at 02:38 AM When would standing committees expire if not stated in the by-laws? At the end of the year, end of the President's tearm (we have adopted Roberts)The new president failed to appoint new committees the first of the year so the club voted to retain all committes for the new year the following month a member objected and said that we could not do that as one of the committe members was not present when we took the action. The committees have become standing with out being in our by-laws ( website, tower site, education and hospitality) we need to update our by-laws.Second the gentlemen elected President this year has filled in for the Treasher when he is on his winter vacation for 3 months says that our by-laws do not prevent him from doing it again this year even though he is President.DanHamradio club
jstackpo Posted February 12, 2013 at 02:53 AM Report Share Posted February 12, 2013 at 02:53 AM Answering your paragraphs one by one...A "Standing Committee" can be established simply by adopting a motion - no need for the establishment to be in the bylaws. It lasts forever, or until a motion rescinding the establishment of it is adopted. Whether these various actions were proper depend on what your bylaws may say about 1) establishing committees, and 2) appointing people to serve on those committees (those are two distinct things). You will have to look to your bylaws and figure things out.Update bylaws?: you bet! (Everybody should)President/Treasurer -- again you will have to look in your bylaws. If you anticipate that you mighthave continuing parliamentarydifficulties or problems youmight want to get in touch witha real live professionalparliamentarian in your area(not virtual ones like us)for consultations.Contact either (or both) the ...National Association of Parliamentarians213 South Main St.Independence, MO 64050-3850Phone: 888-627-2929Fax: 816-833-3893; e-mail: hq@NAP2.org <<www.parliamentarians.org>>orAmerican Institute of Parliamentarians550M Ritchie Highway #271Severna Park, MD 21146Phone: 888-664-0428Fax: 410-544-4640e-mail: aip@aipparl.org<<www.aipparl.org>>for a reference or information. Josh Martin Posted February 12, 2013 at 11:53 PM Report Share Posted February 12, 2013 at 11:53 PM When would standing committees expire if not stated in the by-laws? At the end of the year, end of the President's tearm (we have adopted Roberts)The terms of the committee members expire at the same time as the terms of the officers, unless your rules provide otherwise. The committees themselves do not expire unless the rule creating the committee is rescinded. The continuity of the committees is what makes them "standing."The new president failed to appoint new committees the first of the year so the club voted to retain all committes for the new year the following month a member objected and said that we could not do that as one of the committe members was not present when we took the action.Check what your Bylaws say about appointing committees. If they're silent, then what happened was proper. There is no need for the members appointed to the committees to be present. The Secretary should inform the absent member of his appointment, and he is free to decline. If your Bylaws specify how committee members are to be appointed, your Bylaws must be followed. The committees have become standing with out being in our by-laws ( website, tower site, education and hospitality) we need to update our by-laws.Do your Bylaws specify any standing committees? If so, then you would need to amend your Bylaws to add new ones. If your Bylaws are silent on the subject, then it is proper to establish standing committees by a standing rule, or a special rule of order in some cases.Second the gentlemen elected President this year has filled in for the Treasher when he is on his winter vacation for 3 months says that our by-laws do not prevent him from doing it again this year even though he is President.RONR doesn't provide for anyone to "fill in" for an officer while he is on vacation.A "Standing Committee" can be established simply by adopting a motion - no need for the establishment to be in the bylaws....unless the Bylaws have already established some standing committees.
