Guest confuse Posted March 26, 2015 at 12:33 AM Report Share Posted March 26, 2015 at 12:33 AM If in a meeting someone makes a motion and is voted down, can the same motion be brought up again in the same meeting under new business and gets pass, is that legal
jstackpo Posted March 26, 2015 at 12:45 AM Report Share Posted March 26, 2015 at 12:45 AM No, not proper at the same meeting, unless... A motion to Reconsider the defeated motion is first adopted. And there are time limits and other rules about that. See p. 315. The same motion could be made again (renewed) at the next meeting/session. p.336. But... (another qualification) if nobody raised a point of order that it was improper when the same old motion was made in new business, and the motion was adopted, then the motion stands as adopted. (We don't do "legal" here.)
