Guest Rebecca Posted July 27, 2017 at 02:46 PM Report Share Posted July 27, 2017 at 02:46 PM We have a board with five members. At the last meeting, three members were present, including the chair. A motion was made to rescind a previous motion. The two members voted to rescind. The chair does not vote unless to break a tie. Is this legal? It was not a majority of the entire membership, but it was a two thirds of PRESENT members.
Tom Coronite Posted July 27, 2017 at 04:53 PM Report Share Posted July 27, 2017 at 04:53 PM Absent some other info that would change the scenario it would appear you had a quorum, and the motion to rescind was properly adopted by meeting the 2/3 threshold.
