Agenda Not Posted Timely

A little more information from your bylaws about the agenda would be helpful, but based on what you have posted it does not appear that failure to post the agenda  would invalidate the meeting or any action taken at the meeting. My answer might be different if your bylaws provide that motions cannot be made or considered unless they are first posted on the agenda.

Unless your bylaws prohibit taking certain action unless prior notice has been given and posted on an agenda as provided in the bylaws, votes can be taken and decisions can be made.

Do your bylaws contain any language to the effect that in order for a motion to be made at a meeting previous notice of the motion must be given in the form of including it on a posted agenda?

From whom is the Secretary to obtain this agenda for a meeting? Do your bylaws say he makes it up himself?

What, exactly, do your bylaws say about the president creating the agenda?
