Guest George T. Posted February 21, 2024 at 02:16 PM Report Share Posted February 21, 2024 at 02:16 PM I recently attended an Ohio Township trustee meeting, where an elected trustee refused to participate in an executive session, that the other two trustees motioned for, voted on, and passed by a 2-1 vote. The trustee refused to provide a reason why they would not participate and just sat outside and waited for the other 2 trustees to complete the executive session. As a constituent, isn’t there an obligation for elected officials that are present to participate in executive sessions that were voted on by the board majority? And if that is a breach of their duties as an elected official, does anyone have an guidance on how to hold that elected official accountable? Thanks in advance! Joshua Katz Posted February 21, 2024 at 02:30 PM Report Share Posted February 21, 2024 at 02:30 PM Procedurally, if the rules in RONR govern, he has every right to absent himself from executive session, just as he might miss a meeting. Whether there are any legally-enforceable obligations to his constituents is a question for a lawyer.
