Guest joel Posted May 30, 2010 at 09:13 PM Report Share Posted May 30, 2010 at 09:13 PM Recently, our Board defeated a motion moving a certain amount of monies from the General Fund to a separate account within the Club. Our finance committee recommended a motion to move 50%. Certain board members on their own accord, dismissed the recommendation of the finance committee, and made motion, seconded, debated and the motion failed. Immediately, another motion was made to move 50% of the monies from the General Fund to the separate account. A point of order was raised saying the 2nd motion was out of order and had to wait until our next Board meeting(reference Chapter 10, $38 page327 RONR 10th edition) " A main motion, or a motion for the same amendment to a given motion, cannot fficient to present substanciallya new question...."Is this proper or does one need to wait until the next session since it is essentially the same question with a revised dollar amount? Can anyone elaborate on this? This was almost a priceline.com debacle in which you name your own price until you get what you want.Thank youJoel

Guest joel Posted May 30, 2010 at 09:27 PM Report Share Posted May 30, 2010 at 09:27 PM There was never a motion to reconsider. Instead new motion was raised with a different amount.

The effect of the adoption of this motion is to bring the previously-rejected main motion back before the assembly a second time. Once the main motion is pending upon reconsideration, subsidiary motions to Amend, RONR (10th ed.), §12, pp. 125ff, are in order.

Guest Joel Posted June 2, 2010 at 03:33 PM Report Share Posted June 2, 2010 at 03:33 PM It has no been established after the fact that the Point was founded concerning the 2nd motion not being per RONR.The question is what happens to the 2nd motion? Is it valid? Is it declared void and if so, where is it identified in RONR?Thank you

Is it valid? Is it declared void and if so, where is it identified in RONR?It's too late now to raise a point of order so the second motion stands as adopted though it may be possible to rescind or otherwise amend it. Very little is carved in stone.
Guest joel Posted June 2, 2010 at 04:47 PM Report Share Posted June 2, 2010 at 04:47 PM So even though a Point of Order was brought up prior to the second motion was voted on, it is now too late to do anything about it?

You could have appealed the ruling of the chair. So yes, it's too late to do anything about it now. Since the rule in question is suspendable, violating the rule does not create a continuing breach. The second motion stands.
