Treasurer's position on Slate of officers

Our current Treasurer has withdrawn herself from the election for officers for 2011. This leaves this spot vacant. Is it required that we reopen the nominations at our election meeting to see if anyone is interested in the position, or can we leave this position vacant and choose to have the Executive Committee appoint someone to fill the position at the beginning of the year?

No, elected officers have to be elected. The Executive Committee can fill vacancies if your bylaws explicitly give them this power but that refers to someone vacating an office they actually hold, prior to the end of their term. You can't use vacancy-filling procedures to substitute for an incomplete election.

Yes, you should open the floor to nominations at your election meeting, but you should ordinarily be doing that anyway for all offices, even if you use a nominating committee or other method.

Remember that a lack of nominees is no excuse for not holding the election. If there are no nominees, you conduct the election anyway with blank ballots and let people write in the names of any eligible candidate. You should probably be prepared to conduct more than one ballot before a majority victor emerges.

I would strike the words "or other method." The procedure of nominations from the floor is only used by default if the assembly is using the methods of nominations from the floor (obviously) or nominations by a committee. If the assembly uses some other method (for instance, nominations by mail) the chair should not call for nominations from the floor unless a motion is adopted to reopen nominations (majority vote).
