Guest Jerry Posted January 18, 2011 at 08:58 PM Report Share Posted January 18, 2011 at 08:58 PM Election held last March. Looking back at procedures, it was definitely a botched affair. Nevertheless, the newly elected Board was allowed to continue in good faith. Good faith has turned bad, the Board has not done justice for the club and in fact has done several things that violate the by-laws, as well as caused a drop in participation by the members. At this point, a majority of members would like to see the board replaced. Instead of fighting about what violations have been committed by the board, is it possible to simply rescind the entire election based on the fact that the election procedures were not correct, and elect a new Board to finish the remainder of the term. The by-laws state 2 yrs. OR until the new officers are installed. Where in RONR can we find the right way to rescind the election and then carry on properly with a new one ? Any help would be appreciated, thank you.

hmtcastle Posted January 18, 2011 at 09:12 PM Report Share Posted January 18, 2011 at 09:12 PM Instead of fighting about what violations have been committed by the board, is it possible to simply rescind the entire election based on the fact that the election procedures were not correct, and elect a new Board to finish the remainder of the term.It would depend on which procedures weren't followed. Most improprieties are probably immaterial at this point. However rescinding an election is not based on election irregularities, it's based on a desire to get rid of "officers we don't like". For that, see FAQ #20.
