Guest Mary Posted February 22, 2011 at 12:48 AM Report Share Posted February 22, 2011 at 12:48 AM Our organization's Constitution states that our Executive Committee is elected annually (two-year staggered terms), and that members wishing to run must provide their name to our Secretary at least 30 days before the election, which is conducted at our Annual Meeting. There are four vacancies. If we do not get four people to declare their interest by the deadline, can we take nominations from the floor? Can the previous EC members continue to serve? Iftwo people submit their name before the deadline, and we decide to take nominations from the floor, are the two who met the deadline automatically elected? Thanks! jstackpo Posted February 22, 2011 at 12:54 AM Report Share Posted February 22, 2011 at 12:54 AM Virtually all of your questions depend on the content of your bylaws for their answers. If the bylaws do not forbid floor nominations on election night, then they are OK.Current members may be able to stay in office until there is an election of their successors - another bylaw provision, probably in with the term in office provision. If you get only 4 nominations for 4 positions, they can be declared elected automatically provided your bylaws do NOT require ballot votes. But write-in votes are OK too (if not forbidden).Moral of this story: Go read your bylaws carefully.
Guest Mary Posted February 22, 2011 at 01:21 AM Report Share Posted February 22, 2011 at 01:21 AM JD,Thanks! But as to the matter of two candidates meeting the Constitutional deadline ... are those two automatically elected, regardless of the number of candidates who are nominated from the floor? jstackpo Posted February 22, 2011 at 01:24 AM Report Share Posted February 22, 2011 at 01:24 AM Oh, no. If more than two get floor nominated on election night, you will have a regular (majority wins) election. On each ballot, a person can vote for up to four candidates. Unless nominations from the floor are prohibited in your bylaws, you should call for them may (re)open them, by majority vote no matter how many people showed advance interest, not just if you get fewer than four. There is no requirement that an assembly which conducts nominations by mail must also take nominations from the floor. Nominations from the floor are only automatic if the assembly uses a nominating committee or nominations from the floor as their primary method of nomination. The assembly may reopen nominations regardless of how many nominees are received, but there is no obligation to do so.
