Swimmom Posted October 27, 2011 at 05:39 AM Report Share Posted October 27, 2011 at 05:39 AM At a recent board meeting where elections for new officers were held, we had a situation where there was a tie for one of the positions. All members present at the meeting voted. The current executive board chose to extend the election two more days for that position only and requested the general membership re-vote. Is this appropriate?
jstackpo Posted October 27, 2011 at 05:54 AM Report Share Posted October 27, 2011 at 05:54 AM The extension was essentially correct. You need to complete the election. But I am a little unclear as to who was doing the voting the first time vis a vis during the extension. According to your bylaws, who votes for officers? Gary Novosielski Posted October 27, 2011 at 04:08 PM Report Share Posted October 27, 2011 at 04:08 PM Yeah, if the general membership was voting, then it wasn't actually a board meeting, was it?

jstackpo Posted October 28, 2011 at 04:23 PM Report Share Posted October 28, 2011 at 04:23 PM Strictly speaking, it wasn't up to the board members present at the general membership meeting to (unilaterally) "extend the election". The general membership (only) has that authority by, for example, passing a motion to keep the polls open at some convenient location for a period of time, or, probably better in your situation, to set an "Adjourned meeting" -- RONR, p. 93 & 242 ff. -- and try again with voting on the remaining (previously tied) positions. But done is done. Did you complete the election?
