Guest Bob McFarland Posted October 27, 2011 at 12:45 PM Report Share Posted October 27, 2011 at 12:45 PM Scenario:A board will make a decision on the continued employment of a staff Manager. One of the voting board members will take over the Manager's position, salary and benefits if the Manager is terminated. This is a clear conflict of interest. If the board member does not voluntarily recuse themselves from the vote, can they be forced to recuse themselves? Thanks. jstackpo Posted October 27, 2011 at 12:52 PM Report Share Posted October 27, 2011 at 12:52 PM "Forced"? No, not according to RONR's "direct personal interest" rule - p. 407.However, check your association's bylaws and rules -- you may have a "tighter" C-of-I rule.
