There is then a discussion on a legal or sensitive matter. Can a motion and a vote be taken while in closed session or does the vote have to happen out of closed session? Steven Britton Posted January 8, 2012 at 03:34 PM Report Share Posted January 8, 2012 at 03:34 PM There is nothing In Robert's that prohibits a board from taking a vote in executive session; however, if this board is subject to provisions in a jurisdiction's "Open Meetings" or "Sunshine Laws," you would need to ask a lawyer.
