Guest Sy Posted May 4, 2012 at 08:20 PM Report Share Posted May 4, 2012 at 08:20 PM We do our annual election of officers and bd. members by mail. After the nominating committee slate is mailed the membership has 30 days to make additional nominations. Ater the 30 days a ballot is sent out. The ballot contains all nominated. If there are no additional nominations from the membership and everyone is therefore running unopposed is it necessary for the members to return the ballots or can we just send a letter out stating that since everyone is running unopposed the slate as put forth by the nominjating committee is therefore elected. To do this, if it's okay, can we just do it as a working rule or do we have to revise the By-Laws. Our By-Laws just underwent a complete revision earlier this year. J. J. Posted May 4, 2012 at 09:25 PM Report Share Posted May 4, 2012 at 09:25 PM A ballot is required, unless there is an exception given in your bylaws (pp. 441-2).You would have to put this in your bylaws.
Tim Wynn Posted May 4, 2012 at 09:28 PM Report Share Posted May 4, 2012 at 09:28 PM Absentee Voting is prohibited by RONR, unless specifically authorized by your governing documents. If your bylaws allow for voting by mail, your organization should establish rules to govern the practice.
Guest Sy Posted May 4, 2012 at 10:45 PM Report Share Posted May 4, 2012 at 10:45 PM Tim, Are you saying we need to establish the rules as part of a revision of the By-Law that allows the voting by mail or can we use a working rule to modify it . It's not really a serious issue, but it is a practical one because we get few ballots back when all the positions are unopposed.

Guest Nancy N. Posted May 5, 2012 at 10:15 AM Report Share Posted May 5, 2012 at 10:15 AM ... because we get few ballots back when all the positions are unopposed. What's the problem? The incumbents get a few votes, nobody else gets any -- the incumbents are re-elected. Yes?
Gary Novosielski Posted May 23, 2012 at 12:49 AM Report Share Posted May 23, 2012 at 12:49 AM If there are no additional nominations from the membership and everyone is therefore running unopposed is it necessary for the members to return the ballots or can we just send a letter out stating that since everyone is running unopposed the slate as put forth by the nominjating committee is therefore elected. No, your bylaws would have to authorize election "by acclamation" as an exception when there is no contest for an office. Otherwise the ballot is required. And Nancy N's question is also mine. What do you care if you get only a few ballots back? After all, you were considering advising people NOT to send them back, right?
