Guest Ken Posted May 4, 2012 at 10:03 PM Report Share Posted May 4, 2012 at 10:03 PM We currently have nominations for our Officers in our Union. There are people who were nominated at or last meeting that were not present. Our bylaws allow them to respond within 10 d ays after the nominations. If a nominee does not respond in writing doors that constitute that person declining that nomination. Or bylaws do not specify that.
Trina Posted May 4, 2012 at 10:06 PM Report Share Posted May 4, 2012 at 10:06 PM RONR does not require nominees to accept nomination. So you will not get a direct answer there.Have the nominees responded in some manner within the 10 days specified in your bylaws?
Guest Guest Posted May 4, 2012 at 10:11 PM Report Share Posted May 4, 2012 at 10:11 PM Some have not done so. We are trying to make sure we do it correctly. We are going to change out bylaws to reflect the correct procedure
Trina Posted May 4, 2012 at 10:18 PM Report Share Posted May 4, 2012 at 10:18 PM Well, you have to follow your bylaws in their current form. If it is not clear what happens if a nominee fails to respond in 10 days, the organization is responsible for interpreting the bylaws. RONR (11th ed.) pp. 588-591 contain some useful principles of bylaws interpretation. As far as changing the bylaws to reflect 'the correct procedure', it is up to you all to decide what the correct procedure is in this circumstance, and then amend the bylaws accordingly.Since RONR does not require nominees to respond affirmatively to nomination, RONR will not tell you what correct procedure is if you do want your nominees to respond. George Mervosh Posted May 5, 2012 at 01:28 PM Report Share Posted May 5, 2012 at 01:28 PM If you're voting by ballot and the ballot contains a space for write-ins, as it should when RONR's rules carry the day, why couldn't you vote for them regardless of a response?
