Complaint Hearing

Our By-Laws state that if a complaint is lodged by a member about another member, a hearing is to be conducted by our BOG as soon practicable. Dose this mean we absolutely cannot form an investigative committee or have a mediation before the hearing to hopefully resolve the issue ? Can a member request a mediation or is this over ruled by the hearing By-Law.

It is up to you all to interpret your own bylaws (see RONR pp. 588-591 for some principles to help with that). However in either case, absent something in the bylaws prohibiting it I don't see why the parties couldn't get together informally with some Board members (or even people not associated with the organization) to try to work things out and make a hearing unnecessary.

If the bylaws say a hearing must be held, a hearing must be held. However, if that's all that is said about it, the hearing does not, itself, have to resolve the issue.
